As per the PSA, the government can detain any person for up to 2 years. The government can detain people under this act if it is found that the person might be a threat to the security of the state.

The former CM is currently detained at his residence in Srinagar’s Gupkar which has now been declared as a subsidiary jail.

It may be mentioned that the Supreme Court of India hearing a plea by MDMK chief Vaiko served a notice to the central government over the detention of Abdullah.

A bench comprising of Chief Justice Ranjan Gogoi, Justice SA Bobde and Justice SA Nazeer fixed the hearing date on the plea by Vaiko on September 30.

As per reports, Vaiko’s lawyer has said that Abdullah’s detention has conflicting claims because Home Minister Amit Shah had earlier claimed that he (Farooq Abdullah) was not detained.
